Tinker Playground LLC ("Tinker Playground," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, share, retain, and protect information when you use our website, educational services, games, applications, and other services that link to this Policy (collectively, the "Services").

Because Tinker Playground provides educational experiences that may be used by children and schools, additional protections apply to student and children's information. Schools and parents should also review our FERPA Statement, Data Processing Agreement, and COPPA School Consent Notice.

1. Information We Collect

The information we collect depends on how you use Tinker Playground.

Parent, Teacher, and Other Adult Accounts

When you create or use an account, we may collect:

• your name;
• email address;
• account and authentication information;
• subscription information;
• communications with us; and
• information you choose to provide through the Services.

Student Classroom Accounts

Tinker Playground is designed to minimize the personal information required from students.

Depending on how a School uses the Services, we may process:

• a teacher-selected display name or student identifier;
• classroom or class code;
• student login PIN or similar classroom authentication credential;
• questions and educational activities attempted;
• student responses and correctness;
• response times;
• progress and completion information;
• skill, standard, difficulty, and learning-objective information; and
• derived educational information such as placement, proficiency, progress, or mastery.

Students using standard classroom accounts with class codes and student PINs are not required to provide an email address, telephone number, or other personal contact information.

Family Accounts

Parents or guardians may create child profiles associated with a family account. Depending on the features used, we may process information necessary to maintain the child's profile and educational progress.

Usage and Technical Information

When you use our Services, we may automatically receive certain technical information, such as:

• IP address;
• browser and device type;
• operating system;
• pages or features accessed;
• referral information;
• approximate usage times; and
• diagnostic and performance information.

Optional analytics technologies are used as described in Section 4.

Payment Information

Payments for applicable paid Services are processed by a third-party payment provider.

Tinker Playground does not directly store complete payment-card information. Our payment provider may collect billing, transaction, and other information necessary to process the transaction.

2. How We Use Information

We may use information to:

• provide our educational Services, games, and activities;
• create and maintain accounts;
• authenticate users;
• personalize educational experiences;
• adapt content and difficulty;
• track learning progress and mastery;
• provide parents, teachers, and authorized School personnel with progress information;
• process subscriptions and payments;
• provide customer support;
• send account and Service-related communications;
• maintain and improve the Services;
• understand aggregate Service usage;
• detect and prevent fraud, abuse, and security incidents;
• maintain the security and integrity of our systems; and
• comply with applicable legal obligations.

When student information is provided through School-authorized use, we use that information only for the educational purposes authorized by the School and as necessary to operate, secure, and support the Services.

3. Children's Privacy

Tinker Playground provides educational experiences that may be used by children under age 13.

We take additional measures to minimize the personal information collected from children and to comply with applicable requirements of the Children's Online Privacy Protection Act ("COPPA").

School-Authorized Use

When a School authorizes children under age 13 to use Tinker Playground for an educational purpose, we may rely on the School's authorization as permitted by COPPA.

In this context, children's information is collected for the use and benefit of the School and its authorized educational purposes, and not for unrelated commercial purposes.

Family and Home Use

When Tinker Playground is used outside of a School-authorized environment, a parent or guardian may create or manage a child's profile or provide consent where required.

We do not knowingly collect personal information from a child under age 13 in circumstances requiring parental consent unless the required consent or another legally permitted authorization has been obtained.

How We Treat Children's Information

We do not:

• sell children's personal information;
• use children's personal information for targeted or behavioral advertising;
• create advertising profiles based on children's educational activity; or
• knowingly use children's information for unrelated commercial marketing.

4. Cookies and Analytics

Tinker Playground uses cookies and similar technologies necessary to operate the Services and, where enabled, optional analytics technologies.

Essential Technologies

Essential cookies and similar technologies may be used for:

• authentication;
• maintaining user sessions;
• security and fraud prevention;
• remembering account or profile selections; and
• providing functionality required by the Services.

These technologies may be necessary for certain portions of Tinker Playground to operate.

Analytics

We may use analytics and performance technologies to understand how our Services are used, diagnose problems, and improve our Services.

On our website, optional analytics technologies are used only where permitted and, where applicable, after the user has made the required cookie choice or provided consent.

We do not use children's educational activity to create advertising profiles or for targeted advertising.

Users can control cookies through their browser settings and, where available, Tinker Playground's cookie controls. Disabling essential cookies may prevent certain features from functioning properly.

5. How We Share Information

We do not sell personal information.

We may share information with service providers that help us operate, maintain, secure, and support Tinker Playground. These providers may provide services such as:

• cloud hosting and infrastructure;
• database and authentication services;
• application hosting and content delivery;
• transactional email delivery;
• analytics and performance monitoring;
• data and media storage;
• payment processing; and
• security and technical support.

Service providers may process personal information only as necessary to provide services to Tinker Playground and are subject to applicable contractual, confidentiality, security, and data-protection requirements.

We may also disclose information:

• when required by applicable law, legal process, or valid government request;
• to protect the rights, safety, security, or integrity of Tinker Playground, our users, or others;
• to investigate fraud, abuse, or security incidents;
• in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business, subject to applicable legal requirements; or
• at your direction or with your consent.

Student information collected through School-authorized use is subject to additional restrictions described in our FERPA Statement and Data Processing Agreement.

6. Service Providers and Student Information

We limit access to student information to service providers that reasonably require the information to operate, secure, or support the educational Services.

We do not authorize service providers that receive children's or student personal information through School-authorized use to:

• sell that information;
• use it for targeted or behavioral advertising;
• create advertising profiles based on student activity; or
• use it for unrelated commercial purposes.

Schools can find additional information about material service providers that process student information on our behalf in our Data Processing Agreement.

7. Student Data and Schools

When Tinker Playground processes student information on behalf of a School, the School determines which students use the Services and the educational purposes for which Tinker Playground is used.

Where applicable, we process education records consistent with the Family Educational Rights and Privacy Act ("FERPA") and the School's applicable agreement.

Our practices for School-authorized student information are described in our:

• FERPA Statement;
• Data Processing Agreement; and
• COPPA School Consent Notice.

Parents with questions about School-controlled student records may contact their child's School or Tinker Playground.

8. Data Retention and Deletion

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to provide the Services, comply with applicable agreements, protect our Services, or satisfy applicable legal obligations.

We do not retain children's personal information indefinitely. Children's personal information is retained only for as long as reasonably necessary to fulfill the purpose for which it was collected.

School Student Data

Upon termination of a School's use of the Services, or upon an authorized deletion request from the School, we will delete or return applicable student information from active production systems within 30 days, except where retention is required by applicable law.

Residual copies may temporarily remain in secure backup or disaster-recovery systems and will be deleted or overwritten according to our normal backup-retention cycle, generally no later than 90 days after deletion from active production systems.

Other Account Information

When an account is deleted, we delete or de-identify associated personal information when it is no longer reasonably necessary for the purposes for which it was collected, subject to legitimate security, fraud-prevention, accounting, contractual, or legal retention requirements.

9. Data Security

We maintain administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or misuse.

Depending on the applicable system, these safeguards may include:

• encryption of information in transit;
• authentication and access controls;
• database-level access restrictions;
• row-level security and authorization controls;
• separation of classroom and user access; and
• restricted access to production systems.

No method of electronic storage or transmission is completely secure, and we cannot guarantee absolute security.

10. Parent Rights

Parents or guardians may request to:

• review personal information collected from their child;
• request correction of applicable information;
• request deletion of their child's personal information; and
• refuse further collection or use of their child's personal information where provided by applicable law.

For School-managed student accounts, we may coordinate requests with the applicable School before accessing, changing, or deleting School-controlled student information.

11. Other Privacy Rights and Choices

Depending on where you live and applicable law, you may have additional rights concerning your personal information. These may include rights to:

• request access to personal information associated with you;
• request correction of inaccurate information;
• request deletion of applicable personal information; and
• opt out of marketing communications.

You may unsubscribe from promotional email communications using the unsubscribe link included in those communications.

12. Email Communications

Parents, teachers, and other adult users may receive transactional communications relating to their accounts or use of Tinker Playground.

Adult users who choose to receive promotional or informational communications may unsubscribe at any time.

We do not send commercial marketing emails directly to students through standard classroom accounts.

13. Mobile Applications

Tinker Playground may offer standalone educational games and applications.

Some applications may operate without requiring an account. Depending on the application:

• no account or login may be required;
• educational progress may be stored locally on the device;
• the application may not require a child's name or email address;
• limited analytics may be used to understand application performance and usage;
• no third-party behavioral advertising is shown; and
• children's personal information is not sold.

Where analytics are enabled, they are used to understand application performance and improve the Service, not to create advertising profiles of children.

Deleting an application generally removes information stored locally by that application. Information previously processed by an analytics provider may remain subject to that provider's applicable retention settings.

14. De-Identified and Aggregated Information

We may create or use aggregated or de-identified information that cannot reasonably be used to identify an individual. We may use such information to:

• understand how our Services are used;
• improve educational content and product functionality;
• analyze Service performance; and
• conduct internal research and development.

Where information is treated as de-identified, we will not attempt to use it to identify an individual except where necessary to test or validate our de-identification processes or as otherwise permitted by law.

15. International Use

Tinker Playground is currently intended primarily for users in the United States.

Our Services and service providers may process information in the United States and other locations where our providers operate.

If you access Tinker Playground from outside the United States, applicable privacy laws in your jurisdiction may provide additional rights or requirements.

16. Changes to This Privacy Policy

We may update this Privacy Policy as our Services, privacy practices, or applicable legal requirements change.

If we make material changes affecting how children's personal information is collected, used, or disclosed, we will provide appropriate notice and obtain additional consent or authorization where required by applicable law.

The "Last updated" date at the top of this Policy indicates when this Privacy Policy was most recently revised.
